PFI / PPP (Private Finance Initiative / Public Private Partnership) contracts are by their very nature both specialised and complex, particularly in the area of performance management whereby the Service Provider takes on long term operational risks under a detailed performance-based payment regime. Typically, the regime requires the Service Provider to monitor the services they provide and report any occurrence where a key performance indicator (KPI) may not have been met. The failures are then accounted for in a complex calculation that may ultimately bring about a deduction to the monthly fee. Contractually, each Service Provider has to provide a periodic performance report which includes summary information for the entire contract as well as a breakdown and deduction assessment against each failure event. This report forms the basis of the Service Provider's periodic payment.
